Tunbridge Wells Auctions Ltd carries on business with bidders, buyers and all those in connection with a sale on the following general conditions and on such other terms, conditions and notices as may be referred to herein.


  • ‘’Auctioneer’’ means the firm of Tunbridge Wells Auctions Ltd or the authorised auctioneer as appropriate.
  • ‘’Hammer price’’ means the level of bidding reached at or above any reserve on an item when the auctioneer brings down the hammer.
  • ‘’Terms of consignment’’ means the terms and rates of commission on which Tunbridge Wells Auctions Ltd accepts instructions from sellers or their agents.
  • ‘’Total amounts due’’ means the hammer price in respect of the lot sold together with any premiums.
  • ‘’Sale proceeds’’ means the amount due to the seller being the hammer price of the lot sold less commission at the stated rate.


  • Bidders are required to register their particulars and to satisfy any security arrangements before bidding on any lot.
  • The maker of the highest bid accepted by the auctioneer conducting the sale shall be the buyer at the hammer price and any dispute about a bid shall be settled at the auctioneer’s absolute discretion.
  • Once made, no bid may be withdrawn.
  • Our right to bid on behalf of the seller up to the amount of any reserve and the right to refuse any bid is at the discretion of the auctioneer.


  • In completing the bidding registration on and providing your debit card details, unless alternative arrangements are agreed, you authorise Tunbridge Wells Auctions Ltd if they so wish to charge to the debit card given the full amount payable for items successfully purchased in the auction via
  • We do not guarantee that any live auction service will not be interrupted or error-free or that bids will be received or any information regarding current price will be transmitted in a timely fashion.
  • Lots purchased online with the saleroom will attract an additional charge for this service of 3% of the hammer price plus VAT at the rate applicable.


  • Bidding increments shall be at the auctioneer’s discretion.


  • The buyer shall pay the hammer price together with a premium.  For all sales, the premium is 10% plus online fees to


  • The sale of works of art by living artists or those who have died in the last seventy years that make over 1000 Euros will incur a royalty payment to the Design and Copyright Society.  Please note, the royalty payment is calculated on the rate of exchange of the European Central Bank on the date of the sale.   The royalty will be charged to the buyer at the hammer price and in addition to the buyers’ premium.


  • Immediately a lot is sold, you will pay to us the total amount in cash or in such other way as agreed by us.  We accept cash, bank transfer, or debit cards.
  • All purchases must be paid for in full before release of lots.
  • Card holder not present transactions for example payments by card over the telephone or via are strictly limited to a maximum of 500 pounds per transaction.
  • Payments over 500 pounds must be made by bank transfer.  Bank transfer charges are the responsibility of the purchaser.
  • Purchases will not be released from the saleroom until we are in receipt of cleared funds.  When the purchaser is collecting from the saleroom, the original card used for payment will need to be produced.
  • If a third party is collecting on behalf of the purchaser, we will require prior written authority and also a copy of the invoice and the identification of the third party collecting.


  • The ownership of the lot or lots shall not pass to the buyer until the buyer has paid the full amount due to the auctioneer.


  •  We seek to describe lots accurately.  Prospective buyers are given ample opportunity to view, enquire and inspect before any sale and they must satisify themselves as to the accuracy of any description applied to a lot. 


  • Any lot which proves to be a deliberate forgery may be returned to us within twenty one days of the date of sale of the online auction provided it is in the same condition as when bought and accompanied with  particulars identifying it from the relevant catalogue description with a written statement of defects and if we are satisified from the evidence presented that this lot is a deliberate forgery, we shall refund the money paid by you for the lot including any buyers premium provided the catalogue description reflected the accepted view of experts at the date of the sale. 


  • Goods must be collected within one week of purchase unless prior arrangements are made with the auctioneer.


  • Any damage caused to any  lot at the viewing or after an auction such damage shall be made good by the person committing the damage and the amount will be assessed by the auctioneers who shall have absolute discretion.


  • Where there are two or more commission bids at the same level, we reserve the right to use our absolute discretion to prefer the first bid made.
